Free Trial (Muay Thai/Brazilian Jiu Jitsu)

I HEREBY UNDERSTAND AND ASSUME ALL THE RISKS OF PARTICIPATING IN MUAY THAI, BRAZILIAN JIU-JITSU, KICKBOXING AND MIXED MARTIAL ARTS (hereinafter program) OR ANY OTHER FORM OF PHYSICAL ACTIVITY offered by Square Circle® New York, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

I CERTIFY that I am physically fit, have sufficiently prepared or trained for participation in the programs, activities or events offered by Square Circle® New York, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in these programs, activities, or events onsite / offsite Square Circle® New York premises.

I ACKNOWLEDGE that this Injury Waiver and Release of Liability Form will be used by Square Circle® New York, its program instructors, and their affiliates, and that it will govern my actions and responsibilities at said programs, activities, or events.

IN CONSIDERATION of my agreement with Square Circle® New York, and permitting me to participate in these programs, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVER, RELEASE AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from any Square Circle® New York program, activity, or event, THE FOLLOWING ENTITIES OR PERSONS: Square Circle® New York, its directors, officers, employees, volunteers, representatives, and agents, the program instructors, activity or event holders, activity or event sponsors, activity or event volunteers:

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in these programs, activities, or events, whether caused by the negligence of releasee or otherwise.

I ACKNOWLEDGE that Square Circle® New York and its directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific program, activity, or event on behalf of Square Circle® New York.

I ACKNOWLEDGE that my attendance and/or performance at Square Circle® New York and abroad at events and such may be photographed, filmed and/or taped and used by Square Circle® New York for marketing purposes and I authorize the use of my image and I waive any compensation thereof – even if I discontinue my training at Square Circle® New York.

I ACKNOWLEDGE that these programs, activities and events may involve a test of a person‘s physical and mental limits and may carry with it the potential for death and serious injury. The risks may include, but are not limited to, those caused by facilities, temperature, condition of participant, equipment, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of events, and lack of hydration.

I HEREBY ACKNOWLEDGE that I am fully required to provide my own medical coverage and that Square Circle® New York will not be held liable for any expenses incurred for treatment of injuries while participating in these programs, activities, or events. The injury waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and/or any mutations therefrom (collectively, “COVID”), and voluntarily assume the risk that I may be exposed to or infected by COVID by attending Square Circle® New York (“Club”) and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID at the Club that may result from the actions, omissions, and/or negligence of myself and others, including, but not limited to, Club employees, volunteers, and program participants and/or their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the Club or participation in Club programming (“Claims”). On behalf of myself, I hereby release, covenant not to sue, discharge, and hold harmless the Club, its principals, members, partners, directors, officers, shareholders, employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, agents, and representatives, whether a COVID infection occurs before, during, or after participation in any Club programs.
